Please read these Terms & Conditions ("Terms") carefully before using RoadScope. By accessing or using the RoadScope website and services, you ("you" or "User") agree to be bound by these Terms. If you do not agree, you must not use RoadScope.
RoadScope ("the Service") is a web-based tool that visualises mobile speed camera corridor data on an interactive map. It combines open map data with officially published road safety camera locations to help users see where mobile speed cameras may operate in Victoria, Australia (and potentially other areas of Australia).
Key features of RoadScope include:
RoadScope is currently in an Early Access or MVP (Minimum Viable Product) stage. This means the Service is under active development and is released initially for user feedback and testing.
You acknowledge that RoadScope may have bugs, incomplete features, or inaccuracies as we refine the product. We appreciate your understanding in this phase and welcome feedback, but we make no guarantees that the Service is final or fully polished.
RoadScope is provided by a sole trader in Victoria, Australia. Any references to "we" or "us" in these Terms refer to the owner/operator of RoadScope.
You must be at least 18 years old to use RoadScope. By accessing the Service or creating an account via Google sign-in, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use this Service. We reserve the right to ask for proof of age if necessary.
To utilise RoadScope (beyond possibly a very limited demo view), you need to log in using Google Identity Services. We do not offer a separate username/password system. You will be redirected to Google to authenticate, and upon successful login, Google provides us with your basic profile information (see the Privacy Policy for details on what is received). By signing in, you also agree to comply with Google’s terms of service when using your Google account.
Because RoadScope uses your Google account for access, you are responsible for maintaining the security of your Google account. Do not share your Google account credentials with others or allow others to access RoadScope through your Google account.
If you suspect unauthorised use of your Google account or our Service, you should secure your Google account (for example, change your password, revoke tokens) and notify us of any breach affecting RoadScope.
We are not liable for any loss or damage arising from unauthorised use of your account (though we will try to help if possible).
You must provide accurate information when using the Service. This primarily means your Google profile name and email should be your own and valid. You agree not to impersonate anyone or use a Google account that you are not authorised to use.
We reserve the right to refuse service, suspend, or terminate your access at our discretion if we believe you have violated any eligibility or account rules, or any other provision of these Terms (see Section 11 on Termination).
RoadScope is available in a free version and a paid version. The Free tier provides basic functionality at no cost. The Paid tier (often referred to as "Premium") offers expanded features, such as broader access to corridor visualisation data (for example, access to all camera locations, longer history, or other premium map features).
Details of what each tier includes are described on our website or within the app interface. We reserve the right to change the features of free or paid tiers over time, but any significant changes to paid features will be communicated to subscribers.
All payments for the Paid tier are handled via Stripe Checkout. When you decide to purchase a Paid plan or subscription, you will be directed to Stripe’s secure checkout page. By submitting payment information, you agree to Stripe’s terms and conditions for payment processing. We do not collect your credit card details; Stripe does that on our behalf. Once your payment is successful, Stripe will notify us and we will grant your account access to the premium features.
Prices for the Paid tier are indicated in Australian Dollars (AUD) unless stated otherwise. The pricing and billing cycle (for example, monthly subscription, annual subscription, or one-time purchase) will be presented to you at the time of purchase.
By completing a purchase, you authorise Stripe to charge your provided payment method for the specified amount, and for recurring subscriptions, you authorise charges at each renewal period until you cancel.
All fees are inclusive of any applicable taxes unless stated. If a tax (like GST) is applicable and not included, it will be shown at checkout.
RoadScope may, at its discretion, offer a free trial period or limited free access to premium features. After any trial, if you continue with a subscription, you will be charged.
Change of Mind: We generally do not offer refunds if you simply change your mind or decide you no longer want the Paid service, in accordance with Australian Consumer Law guidelines (a business can refuse a refund for change of mind, as long as this policy is clear). However, you can cancel future subscription renewals at any time (see Cancellation below).
Consumer Guarantees: That said, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). If the service fails to meet a consumer guarantee – for example, if RoadScope’s premium service is not delivered as described, is substantially unfit for its purpose, or has a major problem – you are entitled to a remedy. This may include a refund or compensation, as appropriate, in line with the ACLaccc.gov.au. We will comply with all such legal obligations. Nothing in these Terms is intended to exclude, restrict, or modify your rights under the ACL. (See Section 8 on Limitation of Liability for more details on how we limit liability aside from these non-excludable rights.)
You may cancel a recurring subscription at any time. Cancellation will prevent future billing: you will continue to have access to the Paid tier features until the end of the current billing period that you’ve already paid for, after which your account will revert to the Free tier.
To cancel, you can follow the instructions provided in the RoadScope interface or on the Stripe checkout portal (for example, a "Manage Subscription" link), or contact us for assistance. We do not charge any cancellation fees.
If you cancel during a billing period, we do not provide pro-rata refunds for the remaining time in that period, except where required by law. For one-time purchases (if, for instance, we offer a one-time upgrade instead of a subscription), once the purchase is delivered (that is, premium access granted), it is generally non-refundable except as required under consumer law.
If a subscription renewal payment fails (for example, due to an expired card or insufficient funds), we (or Stripe on our behalf) may notify you. We may retry the charge. If payment is not completed within a certain grace period, we reserve the right to downgrade or suspend your premium access until the issue is resolved.
We may run special promotions or discounts for the Paid tier. Any such offers are subject to their specific terms and may be for a limited time.
We also reserve the right to adjust pricing for the Service or introduce new charges in the future. If we do so for existing subscribers, we will give advance notice via email or in-service notification, and the new rates will apply from the next billing cycle. If you do not agree to price changes, you may cancel before the new price takes effect.
When using RoadScope, you agree to use the Service only for lawful and intended purposes. You must not misuse the Service. Specifically, you agree not to:
We reserve the right to investigate any suspected breach of these rules and to suspend or terminate your access if you violate this Acceptable Use Policy. Serious violations (such as illegal activities) may also be reported to law enforcement or relevant authorities.
Unless otherwise noted, all content and materials in the RoadScope Service are the intellectual property of the RoadScope sole trader/operator. This includes:
These are protected by copyright, database rights, and other intellectual property laws. We retain all rights, title, and interest in and to RoadScope and its content, except for the third-party components listed below.
Using the Service does not grant you ownership of any intellectual property in it. You are only granted a limited licence to use the Service as described in these Terms.
We grant users a limited, non-exclusive, non-transferable, revocable licence to access and use RoadScope for personal, non-commercial purposes, in accordance with these Terms. This means you can view the maps, check the corridor information, and use it for your own lawful purposes.
You may not redistribute, resell, or republish any portion of the Service content without our permission, except for uses permitted under law or under the licences of open data components (see below). For example, you cannot copy our entire corridor list or map interface and create your own competing service from it.
RoadScope incorporates certain open-source or open-data components, which remain under their own licences:
OpenStreetMap
Victorian Government Data
You agree:
As a user, you typically will not be uploading content in RoadScope (since it’s not that kind of service). If in the future we allow any user-generated content (for example, suggesting a camera location or commenting), you would retain ownership of your content but grant us a licence to use it. (We would update the Terms accordingly at that time.)
For now, the primary "content" related to you is your personal data (addressed in the Privacy Policy) and usage information, which aren’t creative works.
Any feedback or suggestions you provide to us about RoadScope are entirely voluntary, and we are free to use them without any obligation to you (feedback is appreciated to improve the service).
We want to clearly credit the external sources and third-party components that make RoadScope possible:
RoadScope is an independent service. We are not affiliated with, endorsed by, or officially connected to Google, Stripe, the Victorian Government, Victoria Police, or the OpenStreetMap Foundation.
The use of these names and data is for providing the Service’s functionality and for factual description. For example, just because we use Google for login does not mean Google endorses RoadScope. Similarly, we use official government data, but RoadScope is not a government website and is not sponsored by any government agency.
Users should not assume the information in RoadScope is an official government communication. Always refer to official sources for confirmation when needed.
Your use of certain features may be subject to third-party terms. For instance, using Google Sign-In means you’re subject to Google’s terms of service and privacy policy. Paying via Stripe means complying with Stripe’s terms for payments.
OpenStreetMap usage via our interface is covered under ODbL which mainly affects us as the distributor (we handle attribution, etc.), but if you somehow extract OSM data, you’d have to adhere to ODbL in how you use it.
By using RoadScope, you also agree to any end-user terms of these third-party services to the extent they apply (though none require you to sign anything separately — it’s mostly about respecting their intellectual property and usage policies, which we have done on our end).
If you violate any third-party terms while using RoadScope (for example, you try to misuse the Google sign-in system or violate OSM’s usage policies), we reserve the right to take appropriate action (which could include terminating your access, as that could jeopardise our relationship with those providers or our ability to use those services).
RoadScope is provided to you on an "AS IS" and "AS AVAILABLE" basis. This section explains the limits of what we promise:
In summary, you use RoadScope at your own risk. If you find errors or bugs, we appreciate reports so we can improve, but we do not accept liability for any problems arising from the use of the app, except as stated in the next section.
To the maximum extent permitted by law, in no event shall RoadScope or its owner/operator be liable for any indirect, incidental, special, consequential or exemplary damages that result from or relate to your use of (or inability to use) the Service.
This includes, for example:
Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the amount (if any) that you paid to us for the use of the Service in the past 12 months. If you have not paid anything (using the free tier), then our liability is $0.
We do not exclude or limit our liability for any guarantee, warranty, right or remedy that you have under the Australian Consumer Law or other applicable laws that cannot be excluded or limited. For example, if our service provision has a major failure under the ACL, you may be entitled to compensation or refund, and nothing in these Terms is meant to override that.
In such cases (where a guarantee is not legally excludable but can be limited), our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
You acknowledge that any driving or travel decisions you make are your sole responsibility. RoadScope is not liable for any outcome of your driving, including speeding infringements or compliance with road rules. Always adhere to posted speed limits and driving regulations regardless of what RoadScope displays.
To the extent permissible by law, you agree to release and hold harmless RoadScope and its owner from any and all claims, liability or losses arising from your use of the Service or from the acts or omissions of other users or third parties in connection with the Service.
(Plain English: This section says if your actions cause us to be sued or fined, you’ll help cover those costs.)
You agree to indemnify and defend RoadScope (and our owner/operator) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) that arise from:
We will promptly notify you of any such claim and allow you to assist in the defence (provided that we may participate with counsel of our own choosing at our expense). This indemnity survives the termination of your account or use of the Service.
We are constantly improving and evolving RoadScope. We reserve the right to modify, suspend, or discontinue any part of the Service (or the entire Service), temporarily or permanently, at any time.
For example, we might add or remove features, change data sources, or shut down the Service if needed. If you have a paid subscription and we discontinue the Service entirely, we will provide a pro-rata refund for any remaining subscription period.
For modifications or temporary suspensions, we’ll try to minimise disruption, but we may not always provide advance notice.
We may update or revise these Terms & Conditions from time to time. If we make a material change, we will notify users by posting the updated Terms on our site with a new "Last updated" date, and/or by a notice within the application.
In some cases, if changes are significant, we might also email users (if we have email contacts, which currently we generally do not collect) or provide a pop-up notice upon login.
Continued use of RoadScope after an update to the Terms constitutes acceptance of the new Terms. If you do not agree to the revised Terms, you should stop using the Service and, if applicable, cancel any subscription (though we’d appreciate the opportunity to address concerns first).
It is your responsibility to check these Terms periodically for changes. We will note the effective date of each version for reference.
You are free to stop using RoadScope at any time. If you wish to delete your account or stop access, you can simply discontinue use (and clear your data as per the Privacy Policy).
If you have a paid subscription and want to terminate it, follow the cancellation steps in Section 3.
We reserve the right to terminate or suspend your access to RoadScope, with or without notice, if you breach any of these Terms or if we are required to do so for legal reasons.
We may also terminate the Service as a whole (as mentioned in Section 10) with notice to all users. If your access is terminated due to a breach of Terms, you may not be entitled to any refunds for purchases (if applicable), and we may block you from creating a new account or accessing the Service in the future.
Upon termination, the provisions of these Terms that by their nature should survive will remain in effect (for example, Intellectual Property rights, disclaimers, limitations of liability, indemnity, governing law, etc. will survive termination).
These Terms & Conditions, and any dispute or claim arising out of or in connection with them or the use of RoadScope, are governed by the laws of the State of Victoria, Australia, and the federal laws of Australia where applicable.
If you are an Australian consumer, you may have the benefit of certain rights or remedies under the law of your state or under Commonwealth law. These Terms do not limit any such rights that cannot be limited by contract.
Jurisdiction: You agree that the courts of Victoria (and courts of appeal from them) shall have exclusive jurisdiction to hear and determine any dispute arising out of these Terms or your use of the Service, except where local consumer law requires otherwise. By using the Service, you waive any objection to the venue of any legal proceedings in Victoria on the grounds of inconvenient forum or otherwise (unless you are entitled by law to require a different venue).
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed from the Terms and the remaining provisions will remain in full effect.
If you have any questions, concerns, or feedback about these Terms & Conditions, you can contact us:
Email: roadscope45@gmail.com
We will do our best to respond promptly and address any issues. Feedback on the MVP and these Terms is welcome as we continue to improve RoadScope.
